PUBLIC NOTICE

SUBSTITUTE TRUSTEE’S SALE NOTICE

WHEREAS, on or about the 16th day of November, 2012, Richard D. Hamilton and Sarah Jane Hamilton executed and delivered a certain Deed of Trust unto William T. Sloan, as Trustee, Mechanics Bank, Beneficiary, to secure an indebtedness therein described, which Deed of Trust was recorded on November 26, 2012, as Instrument Number 2012-10537, of the land records in the Office of the Chancery Clerk of Lafayette County, Mississippi; and

WHEREAS, on or about the 17th day of January, 2023, Richard D. Hamilton and Sarah Jane Hamilton executed and delivered a certain Deed of Trust unto Hughes Brown, PLLC, Trustee, Mechanics Bank, Beneficiary, to secure an indebtedness therein described, which Deed of Trust was recorded on February 3, 2023, as Instrument Number 2023-774, of the land records in the Office of the Chancery Clerk of Lafayette County, Mississippi; and

WHEREAS, on or about the 1st day of January, 2023, BankFirst Financial Services, a Mississippi banking corporation and successor-by-merger to Mechanics Bank, by virtue of the terms and conditions of the Deeds of Trust being assignable at any time without notice to the borrower, became the present owner and holder of the above indebtedness secured by said Deeds of Trust; and

WHEREAS, on the 11th day of September, 2026, BankFirst Financial Services executed and delivered to Elizabeth N. Fisher an Appointment of Substitute Trustee whereby the said Elizabeth N. Fisher was appointed and substituted as Successor Trustee in the aforesaid Deeds of Trust as shown by said appointment duly recorded on September 11, 2026, as Instrument Number 2026-8612 in the land records of the Office of the Chancery Clerk of Lafayette County, Mississippi; and

WHEREAS, default has been made in the payment of the indebtedness secured by said Deeds of Trust, which said default continues, and BankFirst Financial Services, the legal holder of the promissory note(s) secured by said Deeds of Trust, has requested the undersigned to sell the property described hereinafter for the purpose of satisfying the indebtedness and costs of sale.

NOW, THEREFORE, notice is hereby given that I, the undersigned Substitute Trustee, will on the 13th day of October, 2026, at the West front door of the Lafayette County Chancery Building located at 300 North Lamar Boulevard in Oxford, Mississippi within legal hours, offer for sale, at public outcry, to the highest bidder for cash, the following described property located in Lafayette County, Mississippi, being more particularly described as follows, to-wit:

Lot No. 24 of Tuscan Hills Estates, Phase 2, a Subdivision, as said lot is set out and shown on the official map and plat of said subdivision found among the land records of Lafayette County, Mississippi, in Plat Cabinet B, on Slide 191, as of September 19th, 2011, reference to which is hereby made in aid of description hereof.

This property is being sold subject to a first-priority lien of Trustmark Bank. Such title will be conveyed as is vested in me as Substitute Trustee aforesaid without warranty of any kind.
