PUBLIC NOTICE

SUBSTITUTE TRUSTEE’S SALE NOTICE

WHEREAS, on or about the 6th day of September, 2019, Russell L Smith executed and delivered a certain Deed of Trust unto Lamar and Hannaford, P.A, Trustee, Sycamore Bank, Beneficiary, to secure an indebtedness therein described, which Deed of Trust was recorded on September 6, 2019, as Instrument Number 2019-7329, of the land records in the Office of the Chancery Clerk of Lafayette County, Mississippi; and

WHEREAS, on or about the 4th day of April, 2022, Russell L Smith, executed and delivered a certain Deed of Trust unto Lamar and Hannaford, P.A., Trustee, Sycamore Bank, Beneficiary, to secure an indebtedness therein described, which Deed of Trust was recorded on May 10, 2022, as Instrument Number 2022-4368, of the land records in the Office of the Chancery Clerk of Lafayette County, Mississippi; and

WHEREAS, on or about the 1st day of October, 2022, BankFirst Financial Services, a Mississippi banking corporation and successor-by-merger to Sycamore Bank, by virtue of the terms and conditions of the Deeds of Trust being assignable at any time without notice to the borrower, became the present owner and holder of the above indebtedness secured by said Deeds of Trust; and

WHEREAS, on the 27th day of July, 2026, BankFirst Financial Services executed and delivered to Elizabeth N. Fisher an Appointment of Substitute Trustee whereby the said Elizabeth N. Fisher was appointed and substituted as Successor Trustee in the aforesaid Deeds of Trust as shown by said appointment duly recorded on the 8th day of September, 2026, as Instrument Number 2026-08405 in the land records of the Office of the Chancery Clerk of Lafayette County, Mississippi; and

WHEREAS, default has been made in the payment of the indebtedness secured by said Deeds of Trust, which said default continues, and BankFirst Financial Services, the legal holder of the promissory note(s) secured by said Deeds of Trust, has requested the undersigned to sell the property described hereinafter for the purpose of satisfying the indebtedness and costs of sale.

NOW, THEREFORE, notice is hereby given that I, the undersigned Substitute Trustee, will on the 13th day of October, 2026, at the West front door of the Lafayette County Chancery Building located at 300 North Lamar Boulevard in Oxford, Mississippi within legal hours, offer for sale, at public outcry, to the highest bidder for cash, the following described property located in Lafayette County, Mississippi, being more particularly described as follows, to-wit:

TRACT 1:
Beginning on the East line of said Quarter Section at a point 64 rods South of the Northeast corner thereof, and run thence in a Westerly direction to a point 50 rods East of the West line of said Quarter Section, said point being also at a distance of 50 ¼ rods South of the North line of said Quarter Section; thence South 22 rods; thence in an Easterly direction to the East line of said Quarter Section at a point 86 rods South of the Northeast corner thereof; thence North along said Quarter Section line 22 rods to the point of beginning, containing 15 acres, more or less and situated in the Northeast Quarter of Section 4, Township 10, Range 2 West in Lafayette County, Mississippi.

TRACT II:
The South half of a certain 6 acre tract of land conveyed to L. C. Lynch by M.P. Eskridge and wife by deed dated December 12, 1918, as the same appears of record in Deed Book 79 at Page 105, of the deed records of Lafayette County, Mississippi in the Northeast Quarter of Section 4, Township 10, Range 2 West, the parcel herein conveyed contains 3 acres, more or less, and is particularly described as beginning 30 rods East of the West line of said Quarter Section at a point 47 ¾ rods South of the North line of said Quarter, thence in an Easterly direction to a point 50 rods East of the West line of said Quarter Section, said point being 50 ¼ rods South of the North line of said Quarter Section; thence South 22 rods; thence West to a point 30 rods East of the West line of said Quarter Section, said point being 69 ¾ rods South of the North line of said Quarter Section; thence North 22 rods to the point of beginning.

Such title will be conveyed as is vested in me as Substitute Trustee aforesaid without warranty of any kind.
