SUBSTITUTE TRUSTEE’S NOTICE OF SALE
WHEREAS, on June 29, 2017, Austin Baeumlisberger, a single man executed a deed of trust for the benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Fairway Independent Mortgage Corporation., its successors and assigns, which deed of trust was recorded on June 30, 2017, as Instrument No. 2017-5532, in the office of the Chancery Clerk of Lafayette County, Mississippi; Said Deed of Trust was last sold, assigned and transferred to Lakeview Loan Servicing LLC by assignment recorded as Instrument No. 2025-08035 in the office of the Chancery Clerk of Lafayette County, Mississippi.
WHEREAS, the holder of the deed of trust at the time of the substitution substituted McCalla Raymer Leibert Pierce, LLP as Trustee, as authorized by the terms thereof, by instrument recorded February 12, 2026 and spread at large upon the records in the office of the aforesaid Chancery Clerk as Instrument No. 2026-01038 prior to the posting and publication of this notice; and
WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, Lakeview Loan Servicing LLC, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney’s fees, Substitute Trustee’s fees and expenses of sale;
THEREFORE, on August 5, 2026, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the west front door of the Lafayette County Chancery Building in Oxford, Mississippi, the following described land, property and improvements lying and being situate in Lafayette County, Mississippi, to-wit:
TOWNSHIP 9 SOUTH, RANGE 1 WEST, SECTION 5:
A parcel of land located in the Southeast Quarter of Section 5, Township 9 South, Range 1 West, Lafayette County, Mississippi, containing
3.074 acres, more or less. This description being in more detail as follows: Commencing at a 1 inch pipe found accepted as being located at the Northwest corner of the Southeast Quarter of Section 5, Township 9 South, Range 1 West, Lafayette County, Mississippi. Run thence due East a distance of
1930.50 feet to a 1/2 inch rebar found. Thence South 00 degrees 03 minutes 56 seconds West a distance of
835.33 feet to a 1/2 inch rebar found. Thence due West a distance of
320.00 feet to a 1/2 inch rebar found. Thence South 00 degrees 03 minutes 56 seconds West a distance of
399.94 feet to a 1/2 inch rebar found at the POINT OF BEGINNING. Run thence South 00 degrees 03 minutes 56 seconds West a distance of
838.55 feet to a 1/2 inch rebar found on the North right-of-way line of Lafayette County Road No. 279 (
30.00 feet from centerline). Thence North 66 degrees 16 minutes 36 seconds West, along said right-of-way line, a distance of
80.40 feet to a 1/2 inch rebar found. Thence, continuing along said right-of-way line along a circular curve to the left having a radius of
221.65 feet, an arc length of
52.95 feet, a chord bearing of North 85 degrees 39 minutes 45 seconds West, and chord distance of
52.83 feet to a 1/2 inch rebar set. Thence due North, leaving said right-of-way line, a distance of
658.08 feet to a 1/2 inch rebar set. Thence due West a distance of
276.70 feet to a 1/2 inch rebar set. Thence North 41 degrees 34 minutes 22 seconds East a distance of
192.64 feet to a 1/2 inch rebar found. Thence due East a distance of
276.11 feet to the point of beginning of this description.

2.900 acres, more or less. This description being in more detail as follows:

30.00 feet from centerline). Thence continuing along said right-of-way line along a circular curve to the left having a radius of
221.65 feet, an arc length of
45.71 feet, a chord bearing of South 81 degrees 35 minutes 04 seconds West and a chord distance of
45.63 feet to a 1/2 inch rebar set. Thence North 37 degrees 09 minutes 02 seconds West, leaving said right-of-way line, a distance of
171.77 feet to a 1/2 inch rebar found. Thence due North a distance of
184.78 feet to a 1/2 inch rebar found. Thence North 41 degrees 34 minutes 22 seconds West a distance of
192.63 feet to a 1/2 inch rebar found. Thence due North a distance of
198.96 feet to a 1/2 inch rebar found. Thence due East a distance of
276.70 feet to the point of beginning of this description.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, and any matters of record including, but not limited to, those superior to said Deed of Trust first set out above. Said property will be sold on an “as-is” basis without any representation, warranty or recourse against the above-named or the undersigned. The successful bidder must present certified funds in the amount of the winning bid at the time of sale, as well as timely comply with FinCEN data submission and certification requirements, if applicable.
ATTENTION ALL PROSPECTIVE BIDDERS: On March 1, 2026, the data collection and reporting requirements under the U.S. Financial Crimes Enforcement Network (FinCEN) new Anti-Money Laundering Rule (Rule), found at 89 FR 70258, went into effect.* The Rule applies to certain residential real estate sale transactions, including nonjudicial foreclosures, where the transfer is to a legal entity or trust, and the source of funds is non-financed (which includes cash, certified funds, private financing, or financing provided by an institution not subject to a federal Anti-Money Laundering or Suspicious Activity Report requirement.) As part of this Rule, purchasers are required to provide additional information and documentation about themselves, their legal entities, and the source of funds used in the reportable transaction, if applicable. The collection of this information and documentation by the Substitute Trustee is required to comply with the Rule’s reporting requirements, if applicable. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, (2) to final confirmation and audit of the status of the loan with the holder of the Deed of Trust, and (3) to confirmation that the successful bidder has timely provided to the Substitute Trustee all information required by the Rule, 89 FR 70258, if applicable. The Substitute Trustee, on behalf of the holder of the Deed of Trust, reserves the right to rescind the foreclosure sale at its own discretion.
